“Services” refers to any hosting services, including game servers, dedicated servers, and related offerings provided by Glitch Servers.
“User” refers to any individual or entity accessing or using the Website or Services.
2. Use License
Permission is granted to temporarily download one copy of the materials (information or software) on Glitch Servers’ website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:
- Modify or copy the materials.
- Use the materials for any commercial purpose, or for any public display (commercial or non-commercial).
- Attempt to decompile or reverse engineer any software contained on Glitch Servers’s website.
- Remove any copyright or other proprietary notations from the materials; or
- Transfer the materials to another person or “mirror” the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Glitch Servers at any time. In no event shall Glitch Servers or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use provided services, even if Glitch Servers or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
5. Accuracy of Materials
The materials appearing on Glitch Servers’s website could include technical, typographical, or photographic errors. Glitch Servers does not warrant that any of the materials on its website are accurate, complete, or current. Glitch Servers may make changes to the materials contained on its website at any time without notice. However, Glitch Servers does not make any commitment to update the materials.
6. Refunds & Payments
All game server(s), virtual private servers, virtual private servers and dedicated server(s) are to be paid for in advance. Failure to keep up monthly payments on your server can result in suspension and ultimately deletion of your server(s).
If you decide to cancel a subscription with us, please also remember to cancel your PayPal subscription, which in some cases does not auto cancel. Glitch Servers is able to refund all overpayments if the subscription cancellation script fails.
Should you need to raise a payment dispute, the suspension of your service may need to be implemented whilst the investigation is progressing.
No personal credit or debit card details are retained by Glitch Servers directly.
Instead of a money back guarantee or a refund period window we offer fully featured 24hr trials of our services. You can find these in our web shop and you can also request these directly if you require a trial of a service not listed there. You can test our service to its full potential and satisfy yourself of its suitability. As a result refunds are issued only as a result of issues which result in the complete failure of your service to operate. Refunds under these circumstance will be proportional to the period of time the service has been unusable.
Eligible services, as described above, will be deemed ineligible for refunds in cases where they are employed for illegal or malicious activities.
All dedicated servers are treated as a business-to-business transaction and are non-refundable due to their reseller nature. This, in turn, means no refunds can be given.
The invoice charge will be placed 2 days before the actual due date to avoid late payments on automatic renewals. You have until the due date to pay. If the payment is not paid 2 days after the final date, it is suspended, and the system will automatically generate a late fee of up to 10%. This only applies to services that are still active.
At our discretion, we reserve the right to refuse the renewal of services for any reason.
7. Fair Use
By agreeing to our Terms & Conditions, you acknowledge and accept our Fair Use Policy, which is detailed
here. This policy outlines the guidelines and limitations applicable to our services.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom and you irrevocably submit to the exclusive jurisdiction of the courts here.
9. Abuse and Threats
We are committed to maintaining a respectful and safe environment for all users and staff. Any form of abusive or threatening behavior is strictly prohibited. This includes, but is not limited to:
Harassment: Persistent or severe harassment of our staff or other users, including unwanted or threatening communications, will not be tolerated.
Threats: Any threats of violence or harm directed at our staff, users, or their property will result in immediate action, including the possible suspension or termination of services.
Discrimination: Abusive behavior based on race, gender, sexual orientation, religion, nationality, or any other protected characteristic is prohibited.
False Reporting: Making false reports or accusations against our staff or other users with the intent to damage their reputation or disrupt services is not permitted.
In the event of abusive or threatening behavior, we reserve the right to take the following actions:
- Warning: A warning may be issued to the offending user, detailing the nature of the abuse or threat and the necessary corrective actions.
- Suspension: Services may be temporarily suspended if the behavior continues or if the initial warning is ignored.
- Termination: Persistent or severe abuse or threats will result in the permanent termination of services, and access to the Website or Services may be permanently revoked.
- Legal Action: In cases involving illegal activities or threats of violence, Glitch Servers reserves the right to involve law enforcement authorities and pursue legal action.
10. User Accounts and Security
Users are responsible for maintaining the confidentiality of their account login information and for all activities that occur under their account.
Users must notify Glitch Servers immediately of any unauthorized use of their account or any other breach of security.
Glitch Servers is not liable for any loss or damage arising from a user’s failure to protect their account information.
11. Service Availability and Maintenance
Glitch Servers strives to ensure that its services are available 24/7/365, but does not guarantee uninterrupted availability.
Scheduled maintenance may occur from time to time, and Glitch Servers will provide notice of such maintenance whenever possible.
Users acknowledge that downtime or service interruptions can occur and agree that Glitch Servers is not liable for any losses incurred due to such interruptions.
12. Data Privacy and Protection
Glitch Servers respects user privacy and is committed to protecting personal data. For detailed information on how user data is collected, used, and protected, please refer to our Privacy Policy.
13. Termination of Service
Glitch Servers reserves the right to terminate or suspend any user’s access to services if the user violates these terms, any part of
our acceptable use policy,
our fair usage policy, engages in any prohibited activity, or for any reason deemed necessary by Glitch Servers, without obligation to provide a refund.
Users may terminate their services by following the cancellation process in our client/billing area.
14. Dispute Resolution
Any disputes arising from or related to these Terms of Service shall be resolved through binding arbitration in accordance with the rules of the arbitration institution selected by Glitch Servers.
In the event that arbitration is not suitable, disputes shall be resolved by the competent courts in the United Kingdom.
15. Prohibited Conduct
Users are prohibited from engaging in any activities that:
- Violate any laws or regulations.
- Infringe on the rights of others or result in unauthorized access to or use of third-party systems.
- Disrupt or interfere with the operation of the Website or Services.
- Involve the distribution of malicious software or other harmful code.
16. Links to Third-Party Sites
The Glitch Servers Website may contain links to other websites or services that are not owned or controlled by Glitch Servers. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Glitch Servers shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
We strongly advise you to read the terms and conditions and privacy policy of any third-party website or service that you visit.
17. Force Majeure
Glitch Servers shall not be held liable for any failure to perform its obligations under these Terms of Service if such failure is due to events beyond its reasonable control, including but not limited to natural disasters, acts of war, or other emergencies.
18. Support Response Time
We aim to respond within 2 hours of receiving a ticket, though our usual response times are often quicker. However, please be aware that during busy periods, it may take up to 72 hours to receive a response.
Repeatedly submitting tickets in quick succession will put your support request to back of the queue. Continued misuse of the ticket system will result in a temporary or permanent ban from accessing support.
19. Server Backups
Glitch Servers provides backups for the following services by default, with two copies (snapshots) for Virtual Dedicated & Virtual Private Servers. Shared Game Servers get a minimum of 5 backups (excluding free tiers of services). All stored on a seperate machine.
Glitch Servers does not provide backups for Dedicated Servers. You are responsible for managing data backups, and Glitch Servers is not liable for any data loss due to hardware or software issues.
We strongly recommend that users maintain additional copies of their data elsewhere, as Glitch Servers is not responsible for the security or preservation of your data.
These backups are securely stored on a remote server and are not directly accessible by customers.
If backups are unavailable due to an error caused by the user or Glitch Servers, Glitch Servers is not responsible for any loss of your data.
